We handle the import of toys and recreational items, a category with specific safety requirements. Today the control is mostly resolved inside the market, not at customs: Res. SIyC 313/2025 (Art. 8) repealed the article of Res. 163/2005 that authorized customs intervention before release, after Res. 237/2024 (Art. 6) had already dispensed the Dirección General de Aduanas from that control. What's still checked at the border is the phthalate restriction: Res. 373/2009 (Art. 3) requires filing a technical report or a sworn declaration from the importer with customs, backed by an INTI-Plásticos record.
The rest of the control moved to market surveillance, backed by a Declaración Jurada de Conformidad (Res. SIyC 313/2025), with testing —depending on the product— against IRAM-NM 300, ISO 8124, ASTM F963, or EN 71 / EN IEC 62115. The conformity mark —seal plus QR code, which points to both the Declaración de Conformidad and the product's certification— originates in Res. SIyC 237/2024 and has been enforceable since October 1, 2025 (Res. 26/2025); for toys whose packaging or primary wrapping is in direct contact with food, or that are sold together with food, that enforceability was suspended until October 1, 2026 (Res. Res. SIyC 313/2025 — Declaración Jurada de Conformidad for toys
In force since August 14, 2025, it unified the technical regulation of five consumer categories —lighters, sunglasses, toys, children's bicycles, and wood-based panels— and, in its Art. 8, repealed the article of Res. 163/2005 that authorized the Dirección General de Aduanas to intervene before clearance. Compliance control today rests on a sworn declaration backed by testing, not on a pre-release intervention.
Testing and conformity marking (Res. SIyC 237/2024 and Res. SIyC 313/2025)
Depending on the product, testing is run against IRAM-NM 300, ISO 8124, ASTM F963, or EN 71 / EN IEC 62115. Res. 583/2008 (Ministerio de Salud) — phthalate restriction
Sets a 0.1% mass limit for certain phthalates (DEHP, DBP, BBP, and DINP/DIDP/DNOP in products that can be put in the mouth) in toys and childcare articles. It has no repealing rule; Res. SIyC 313/2025 expressly points to it (Apéndice III) as a standing requirement. Since Res. 1948/2019, it covers imports and domestic sale, not exports. Border verification is done via a sworn declaration from the importer to Customs, backed by an INTI-Plásticos record (Res. 373/2009, Art. 3).
